These Terms & Conditions govern your use of madebymothernature.ca and purchases made from Made By Mother Nature Products Inc.

Throughout these Terms, “Made By Mother Nature,” “we,” “us” and “our” refer to Made By Mother Nature Products Inc. “You” and “your” refer to a visitor, customer or other user of the Site.

By accessing the Site, creating an account or placing an order, you agree to these Terms and to the policies referenced in them.

Please do not use the Site or place an order if you do not agree with these Terms.

Eligibility

To place an order, you must:

• Have reached the age of majority in your province or territory, or have the authorization and supervision of a parent or legal guardian
• Provide accurate and complete order information
• Have authority to use the payment method provided
• Use the Site and products only for lawful purposes

You must not use the Site to violate any law, infringe another person’s rights, transmit malicious software, interfere with Site security or engage in fraudulent activity.

Our products

Made By Mother Nature offers skincare, hair-care, soap and other personal-care products.

We make reasonable efforts to provide accurate:

• Product descriptions
• Ingredient information
• Sizes and weights
• Instructions for use
• Photographs
• Prices
• Availability information

Because many of our products are made in small batches and contain naturally derived ingredients, minor differences in colour, texture, scent or appearance may occur. These natural variations do not necessarily indicate a defect.

Screen settings, lighting and photography may also affect how colours and packaging appear online.

Please review the product description, ingredient list and instructions before purchasing and again before use. Contact us before ordering if you have questions about a product or ingredient.

Personal-care and cosmetic information

Information provided on the Site is for general product and educational purposes. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Individual skin, hair and product experiences can vary. We cannot guarantee that a particular product will be suitable for every person or produce a particular result.

Before using a new personal-care product:

• Read the full ingredient list
• Follow the provided directions
• Perform a patch test when appropriate
• Avoid any ingredient you know you are sensitive or allergic to
• Stop using the product if irritation or an unexpected reaction occurs

Seek advice from a qualified healthcare professional when you have a medical condition, significant allergy, persistent reaction or uncertainty about whether a product is appropriate for you.

Nothing in this section limits rights or remedies that cannot legally be excluded.

Product availability

Products may be available in limited quantities and may be changed or discontinued.

Placing an item in your cart does not reserve it. Availability is confirmed when the order is processed.

We may limit quantities when reasonably necessary, including where:

• Inventory is limited
• An order appears fraudulent
• A pricing or listing error has occurred
• Products are being purchased for unauthorized resale
• Fulfilling the order would violate applicable law

If we cannot fulfill an item after payment has been processed, we will contact you and issue an appropriate refund.

Orders

When you place an order, you agree that the order information you provide is current, complete and accurate.

You will receive an order confirmation at the email address provided. Please review it promptly and contact us if something is incorrect.

We may contact you when additional information is needed to:

• Confirm an address
• Verify an order
• Prevent fraud
• Resolve an inventory issue
• Arrange local delivery

We may decline or cancel an order before shipment due to product unavailability, suspected fraud, incorrect pricing, payment failure, delivery restrictions or another legitimate operational or legal reason.

When we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Prices, taxes and currency

Unless otherwise stated, prices on the Site are displayed in Canadian dollars.

Prices may change without notice. A price change will not affect an order that has already been accepted, except where there has been an obvious error.

Applicable taxes and shipping charges are calculated and displayed during checkout before payment.

Promotions, discounts and gift offers may have separate conditions, expiry dates, product exclusions or minimum-purchase requirements. Unless stated otherwise, promotions cannot be combined.

Payment

Payment must be completed using one of the methods available at checkout.

Payment services may be provided by Shopify Payments, Shop Pay, PayPal or another authorized provider. Your use of a third-party payment option may also be governed by that provider’s terms and privacy practices.

You confirm that:

• You are authorized to use the selected payment method
• The billing information provided is accurate
• Sufficient funds or credit are available

We are not responsible for charges imposed independently by your bank, credit-card issuer or payment provider.

Shipping and delivery

Processing times, shipping options, delivery estimates, local delivery and related costs are described in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates and can be affected by weather, carrier delays, holidays, remote destinations and other circumstances outside our reasonable control.

Please provide a complete and accurate shipping address. Additional shipping charges may apply when an order must be resent because an incorrect or incomplete address was provided.

We will assist with delayed, damaged or missing shipments as described in our Shipping Policy and as required by applicable law.

Returns, refunds and exchanges

Returns, refunds, exchanges, damaged products and order cancellations are governed by our Returns & Refunds Policy, which forms part of these Terms.

Please review that policy before purchasing.

Our voluntary return rules do not limit any rights or remedies available under applicable consumer-protection law.

Customer accounts

You may have the option to create or use a customer account.

You are responsible for:

• Providing accurate account information
• Protecting your login credentials
• Maintaining the confidentiality of your account
• Notifying us promptly of suspected unauthorized use

We may suspend or restrict an account where reasonably necessary to protect the customer, the Site or the business from fraud, misuse or security threats.

Reviews, photographs and other submissions

You may be able to submit reviews, comments, questions, photographs, videos or other content.

By submitting content, you confirm that:

• The content is truthful and based on your genuine experience
• You own it or have permission to submit it
• It does not infringe another person’s copyright, trademark, privacy or other rights
• It is not unlawful, threatening, abusive, misleading or fraudulent
• It does not contain malicious code or confidential information belonging to another person

You grant Made By Mother Nature a non-exclusive, worldwide, royalty-free licence to display, reproduce, format and use submitted reviews and content in connection with our website, social media, advertising and business promotion.

This permission does not transfer ownership of your original content to us.

We may remove or decline content that violates these Terms, applicable law, platform rules or the rights of another person.

Intellectual property

The Site and its content—including text, product descriptions, photographs, graphics, logos, designs, videos and branding—are owned by or licensed to Made By Mother Nature Products Inc. and are protected by applicable intellectual-property laws.

You may use the Site for personal, non-commercial shopping and informational purposes.

Without written permission, you may not:

• Copy or reproduce substantial Site content
• Use our photographs or branding commercially
• Resell or republish Site materials
• Scrape or systematically collect Site data
• Use our trademarks or product content in a misleading way
• Create derivative commercial materials from our content

Prohibited activities

You must not:

• Use the Site for an unlawful or fraudulent purpose
• Attempt to gain unauthorized access to the Site or another account
• Introduce viruses, malware or harmful code
• Interfere with Site operation or security
• Scrape or harvest information without permission
• Submit false order or account information
• Impersonate another person

• Infringe intellectual-property, privacy or other legal rights
• Harass, threaten or harm another person through the Site
• Use the Site to send spam or unsolicited messages

We may restrict access, cancel an affected order or take other reasonable action when these rules are violated.

The Site may contain tools, services, payment options or links supplied by third parties.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for the independent content, availability, security or practices of a third-party website or service. Please review its terms before using it or providing information.

Website information and availability

We work to keep the Site accurate and available, but errors, interruptions or outdated information can occasionally occur.

We may:

• Correct typographical, pricing or product-information errors
• Update Site content
• Perform maintenance
• Modify or discontinue a feature
• Temporarily restrict access for security or technical reasons

When an error materially affects an order, we will contact the customer and provide an appropriate correction, cancellation or refund.

Historical blog posts or older content may not reflect current products, ingredients, prices or availability.

Disclaimer and limitation of liability

Nothing in these Terms excludes or limits a right, warranty, condition or remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law:

• The Site is provided on an “as available” basis
• We do not guarantee that the Site will always be uninterrupted or error-free
• We are not responsible for indirect, incidental, special or consequential losses arising solely from Site interruption, third-party services or circumstances outside our reasonable control
• We are not responsible for a customer’s failure to follow product instructions, review ingredients or discontinue use after an unexpected reaction

Where liability can lawfully be limited, our total liability relating to a particular order will not exceed the amount paid for that order.

These limitations do not apply where prohibited by law, including where liability cannot legally be excluded.

Responsibility for unlawful use

You are responsible for reasonably foreseeable losses or expenses caused by your fraudulent, unlawful or intentionally harmful use of the Site or by a serious violation of these Terms.

This section does not require you to compensate us for losses caused by our own negligence, misconduct or violation of law.

Events outside reasonable control

We are not responsible for a delay or failure caused by events outside our reasonable control, such as:

• Severe weather
• Natural disasters
• Fire or flood
• Labour disruption
• Carrier interruption
• Government action
• Widespread internet or utility failure
• Supply-chain interruption

We will make reasonable efforts to communicate significant delays and fulfill or resolve affected orders fairly.

Changes to these Terms

We may update these Terms to reflect changes to our business, products, technology, policies or legal obligations.

The current version will be posted on this page with an updated revision date.

Changes will apply prospectively unless applicable law requires otherwise. Terms in effect when an order was placed will continue to govern that order where appropriate.

Governing law

These Terms and your use of the Site are governed by the laws of British Columbia and the applicable federal laws of Canada.

Nothing in these Terms prevents a consumer from exercising rights available under mandatory consumer-protection legislation.

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed only to the extent necessary. The remainder of the Terms will continue in effect.

No waiver

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

Entire agreement

These Terms, together with the policies and information incorporated by reference, form the agreement governing use of the Site and online purchases.

They do not replace rights or obligations that applicable law requires.
